Terms and Conditions

Booking and Reservation. Reservation requests are subject to availability. A valid credit card is required to secure a reservation. Full payment must be made in advance to confirm the reservation.

Cancellation Policy. Cancellations made up to 48 hours prior to the check-in date will receive a full refund. Cancellations made within 24 hours of the check-in date will incur a 50% cancellation fee.

Check-in and Check-out: Check-in time is 3:00 PM, and check-out time is 11:00 AM. Early check-ins and late check-outs are subject to availability and may incur additional charges.

Occupancy and Guests. The villa has a maximum accommodation occupancy limit of 26 guests. Additional guests may be accommodated at an extra charge. The primary guest must be at least 21 years old.

Property Usage. The villa is for accommodation purposes only. Parties and events are not allowed without prior approval and booking. Any damage to the property or its contents will be the responsibility of the guest and may result in additional charges.

Security Deposit. A security deposit of $100 amount will be authorized on the guest’s credit card upon check-in. The deposit will be refunded within 3-5 days after check-out, provided there are no damages.

House Rules. Guests are expected to adhere to all house rules provided in the villa. Quiet hours are observed from 9:00 PM to 8:00 AM.

Pets and Smoking. No pets are allowed.

Smoking. smoking is strictly prohibited inside the villa. A cleaning fee will be charged for any violations.

Liability. The management is not responsible for any loss or theft of personal belongings. Guests are advised to secure their valuables.

Changes to Reservation. Any changes to the reservation must be communicated in writing and are subject to availability.

Termination of Stay. The management reserves the right to terminate a guest’s stay if they violate the terms and conditions or engage in disruptive behavior.

By booking I certify that I have read and accept the Terms of Use and Privacy Statement and I have read and understand the Rate Description and Rate Rules for my reservation.

I am at least 21 years of age and at least one guest in my party will meet the minimum check-in age requirement for the B&B upon arrival.

MATERIALS USAGE NOTICE. The documents, data, and information on the Site (collectively, the “Materials”) are exclusively provided by Banana Leaf Villa (BLV) for non-commercial, individual use. These are intended for prospective and confirmed BLV guests to inquire about or make travel reservations and related services—solely for Authorized Users. BLV retains the right to modify the terms, conditions, and notices governing the Materials and the Site at any time.

AGREEMENT FOR USE. You warrant that you are at least 21 years of age and possess the legal authority to enter into this agreement and to use this Site in accordance with all terms and conditions herein. You agree to be financially responsible for all your use of this Site (as well as for use of your account by others, including without limitation minors living with you). You agree to supervise all usage by minors of this Site under your name or account. You also warrant that all information supplied by you or members of your household in using this Site is true and accurate and without limitation, or any false or fraudulent reservation. You agree that the reservations facilities of this Site shall be used only to make legitimate reservations or purchases for you or for another person for whom you are legally authorized to act. You understand that overuse or abuse of the reservation facilities of this Site may result in your being denied access to such facilities.

BOOKING TERMS AND CONDITIONS. When reserving services with potential fees, you agree to comply with purchase terms, including timely payment and adherence to rules on rate availability. You are fully responsible for all charges, fees, taxes, and duties related to site use. Banana Leaf Villa (BLV) is independently owned, and transactions occur directly with BLV. Your agreement extends to the owner of BLV, if applicable, and adherence to specified booking terms and conditions.

WIRELESS RESERVATIONS. Functionality is not guaranteed with all types of mobile devices in using this Site. You should contact your service provider directly for technical assistance or any questions. Please note that security features vary by carrier/service provider and mobile device. Additional minutes/charges may apply and may be charged by your mobile carrier/service provider.

CURRENCY CONVERSION. Currency rates are based on publicly available sources and should be used as guidelines only. Room rates are guaranteed only in B&B local currency. Currency quotes are not updated every day. The currency information supplied by this Site is believed to be accurate, but BLV and/or its parent, subsidiaries and affiliates do not warrant or guarantee such accuracy.

LIMITED LICENSE TO VIEW AND COPY. The information and content displayed on this Site (“BLV Materials”) is the property of BLV. The reproduction, retransmission and downloading of BLV information, other than for non-commercial individual use, is strictly prohibited.

This Site is to be used by Authorized Users for personal use only. This site is strictly prohibited for Commercial uses. You are granted a limited, non-transferable, revocable license to view and copy the Materials solely for your personal use, subject to the restrictions below If you are currently an Authorized User.

USER RESPONSIBILITIES. By using this site, you agree not to: (a) transfer Materials to third parties without prior written permission from BLV; (b) interfere with connected networks; (c) use devices or software that disrupt the site’s proper functioning; (d) transmit files containing viruses or instructions that may harm the site or its systems; (e) send communications violating local, state, federal, or international laws; (f) send communications with defamatory, libelous, abusive, or obscene content; or (g) send communications infringing upon the rights of any third party.

Protecting Intellectual Property: This site and its materials are safeguarded by trademarks, patents, trade secrets, and other proprietary rights belonging to BLV companies and/or other parties. No license or right is granted to users for the use of these intellectual properties. Materials may not be reproduced, distributed, posted, displayed, uploaded, or transmitted without explicit permission. GOVERNING LAW. These Terms of Use shall be governed by, construed, and enforced in accordance with the laws of the State of Florida, United States, without regard to its conflicts of law rules. The exclusive jurisdiction for any dispute not covered by the terms of the Arbitration provision set forth in this Agreement or Materials may be filed only in the state or federal courts located in the State of Florida, United States.

ARBITRATION. Dispute Resolution and Arbitration Clause: Except for claims related to BLV trademarks or service marks, and to the extent allowed by law, any dispute arising from the use or performance of this Site, these Terms of Use, the Materials, or the Agreement (referred to as ‘Covered Claims’), which seeks relief in the form of money damages and/or attorneys’ fees, will be subject to arbitration through the American Arbitration Association (AAA). In a proper case, BLV retains the right to seek temporary restraining orders, temporary or preliminary injunctive relief, and/or declaratory relief (excluding declarations related to the amount of money damages) from a court of competent jurisdiction.

The arbitration process will involve one independent arbitrator, typically an attorney or retired judge, and will adhere to the Commercial Arbitration Rules of the AAA. Matters covered by the Federal Arbitration Act (9 U.S.C. 1, et seq.) will be governed by it, not by any state arbitration law. Both you and BLV waive the right to pursue other available resolution processes, such as a court action or administrative proceeding, for these disputes, and waive the right to a jury trial. While the rules in arbitration differ from those in court, an arbitrator can award similar damages and relief, abiding by the limitations set forth in the Agreement.

The arbitrator will base decisions on this Agreement and Materials, apply applicable law, and must not rule inconsistently with it. The arbitrator may not (1) combine more than one individual’s claim without all parties’ consent, (2) participate in notifying others of potential claims, or (3) arbitrate or preside over any form of a class, mass, collective, or representative proceeding. The arbitrator’s award will encompass proper relief in terms of money damages (with interest on unpaid amounts at the maximum rate allowed by law), attorneys’ fees, and costs. The arbitrator’s decision will be final and binding on all parties, and judgment on the award may be entered in any court of competent jurisdiction.”

If a party breaches this arbitration agreement by initiating legal action for a Covered Claim in a court of law, the court (not an arbitrator) will have the power to address disputes related to the interpretation, formation, existence, enforceability, validity, and scope of these Terms of Use. This includes matters pertaining to the Agreement, this arbitration agreement, and the Waiver of Class, Mass, Collective, and Representative Claims.

However, if a party adheres to the arbitration agreement, initiating arbitration without filing a complaint in a court of law, the arbitrator will possess the authority to settle disputes concerning the interpretation of these Terms of Use for discovery purposes or the merits of the underlying claim. Nevertheless, the arbitrator will not have the authority to address disputes regarding the formation, existence, enforceability, or validity of the Terms of Use, encompassing the Agreement, this arbitration agreement, and the Waiver of Class, Mass, Collective, and Representative Claims.”

CONFIDENTIALITY OF ARBITRATION PROCEEDINGS. Except as compelled by law, the entirety of the arbitration proceedings, encompassing any rulings, decisions, or orders of the arbitrator, shall be kept confidential and not disclosed to anyone other than the parties involved in this Agreement.

LIMITATION ON COMMENCING COVERED CLAIMS. All Covered Claims must be initiated within one (1) year from the occurrence of the facts giving rise to the claim or action; otherwise, the claim or action will be barred. This Limitations Period provision does not apply to residents of New Jersey and is not applicable where local law prohibits its enforcement

WAIVER OF CLASS, MASS, COLLECTIVE, AND REPRESENTATIVE CLAIMS: Subject to applicable law, you agree not to initiate or participate in a class action, file, or seek a class, mass, collective, or representative arbitration against any BLV company for Covered Claims. You further agree that such claims can only be pursued in your individual capacity and not on behalf of other individuals.”

MISCELLANEOUS PROVISIONS. This Agreement represents the entire understanding between the parties concerning its subject matter, prevailing over all prior oral and written agreements. BLV’s failure or delay in exercising any right or remedy, or enforcing the terms and conditions herein, does not constitute a waiver. If any part or provision of this Agreement is deemed invalid, unenforceable, or void, the remaining portion shall remain in full force and effect. In the event the Waiver of Class, Mass, Collective, and Representative Claims is unenforceable, any claim pursued on such basis must be filed in a court of competent jurisdiction, and that court shall be the exclusive forum for such claims. CHILDREN

Our websites are not intended for children, and we do not intentionally solicit or collect personal information from individuals under the age of 18. If we are notified or otherwise discover that a minor’s personal information has been improperly collected, we will take all commercially reasonable steps to delete that information. In limited instances, we may have a campaign or program targeted toward children. Additionally, you may have the right under local law to lodge a complaint directly with us or your local data protection supervisory authority. We encourage you to attempt resolution with us first before escalating the matter to the supervisory authority.

  • Requesting Corrections and Deletion. If you believe any information about you is inaccurate, you can ask us for corrections. Verification of accuracy will precede rectification.

You have the right to request the erasure of your information if we no longer require it for the original purpose, if you’ve withdrawn consent, objected to further use, or if its use is unlawful or mandated by legal obligations. However, there may be instances where we cannot fulfill your request due to ongoing legal obligations or the necessity of the information for legal claims.

To restrict how we use personal information

We collect the Personal Information identified above directly from you, from other persons/entities making a reservation on your behalf (e.g., travel agent, a member of your travel party, someone making the booking on your behalf), automatically via cookies and tracking technologies when you access our online services, from travel partners, including airlines and rental car agencies (that are generally independently owned and operated). We may also obtain Personal Information from data enrichment providers.

We may sell or share with third parties for cross-context behavioral advertising or targeted advertising the following categories of Personal Information:

Retention of Personal Information

We keep the categories of Personal Information described above for as long as necessary for the purposes described in this section or as otherwise authorized by law. This generally means holding the Personal Information for as long as one of the following apply: 

  • Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the Personal Information.  
  • Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected. 
  • The Personal Information is reasonably required to protect or defend our rights or property; or 
  • We are otherwise required or permitted to keep your Personal Information by applicable laws or regulations.

Where Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires.

To opt out of offline sales or Personal Information, please contact us. If you would like to use a universal opt-out preference signal, please download and use a browser supporting the Global Privacy Control (GPC) browser signal. Right to Limit Use and Disclosure of Sensitive Personal Information. We do not process sensitive Personal Information for purposes to which the right to limit use and disclosure of sensitive Personal Information applies, and therefore we do not provide such a right.

Authorized Agents. The CCPA allows California consumers to designate an authorized agent to exercise their rights under CCPA. If you use an authorized agent to submit a request, we will ask your agent to provide information to demonstrate the agent has your authorized consent to submit a request. Proof of authorization evidenced by your signed permission should be submitted to info@bananaleafvilla.com. We may also ask you to provide information to verify your identity directly with us.

Shine the Light

Under California’s “Shine the Light” law (Cal. Civ. Code § 1798.83), California residents who provide us certain Personal Information are entitled to request and obtain from us, free of charge, information about the Personal Information (if any) we have shared with third parties for their own direct marketing use.  Such requests may be made once per calendar year for information about any relevant third party sharing in the prior calendar year.
